California Healthy Youth Act (CHYA)

Dear CVUSD Families,
Following an extensive review process last school year that included stakeholder engagement meetings and public discussion at Board of Education meetings, CVUSD adopted new Comprehensive Sexual Health & HIV/AIDS instruction materials for 7th and 9th grade to be in compliance with the California Healthy Youth Act (2016). Here is the timeline for when the new student materials will be available:
- High school 9th grade student materials are now available to examine here. Only these specific handouts, presentations, and activities will be presented to students.
- Middle school instruction for 7th grade students will occur in Spring 2022.
- Middle school 7th grade student materials are now available to examine here. Only these specific handouts, presentations, and activities will be presented to students.
- Materials intended for students with an IEP who access a Specialized Program are now available to examine here (Middle School) and here (High School). Only these specific handouts, presentations, and activities will be presented to students.
As required by law, prior to delivering the instruction to students, parents/guardians will be notified by school site staff and provided an opportunity to have their child “opt-out” of receiving the instruction, either in whole or for portions of the materials.

Enacted January 1, 2016, The California Healthy Youth Act (CHYA) integrates the instruction of comprehensive sexual health education and HIV prevention education. The bill renamed the California Comprehensive Sexual Health and HIV/AIDS Prevention Education Act to the California Healthy Youth Act. The bill requires school districts to ensure that all pupils in grades seven to twelve, inclusive, receive comprehensive sexual health education and HIV prevention education at least once in middle school and at least once in high school. In the CVUSD this takes place in 7th grade for middle school and in 9th grade for high school. Additional information regarding the California Healthy Youth Act can be found on the California Department of Education's website.
California Education Code 51938(a) states "A parent or guardian of a pupil has the right to excuse their child from all or part of comprehensive sexual health education, HIV prevention education, and assessments related to that education through a passive consent (“opt-out”) process. A school district shall not require active parental consent (“opt-in”) for comprehensive sexual health education and HIV prevention education." This notification (English / Spanish) is modified from the CA Department of Education's sample letter and will be provided in advance to the parent/guardian by the student's teacher or administrator.

- Beginning March 24, 2021, electronic copies of Rights Respect Responsibilities were made available for public review online, with hard copy materials of Teen Talk and Positive Prevention Plus made available for public review at the CVUSD District Educational Center (1400 E Janss Road) and all middle school and high school main offices. These materials were removed in June 2021 after the Board of Education adopted materials.
